Terms of Service for MomentFold

These Terms of Service (“Terms”) govern your download, access, and use of the MomentFold application (MomentFold（折影）, the “App”) on iOS. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. License Grant

Subject to your compliance with these Terms, the developer grants you a limited, revocable, non-exclusive, non-transferable license to download, install, and use MomentFold on any Apple-branded device that you own or control, strictly as permitted by Apple’s App Store Terms of Service and Standard End User License Agreement (EULA).

2. Ownership of Your Photos and Media

  • Your Content Stays Yours: You retain full and exclusive ownership, copyright, and all intellectual property rights in and to all photos, videos, albums, and media in your Apple Photos library.
  • No License to Us: MomentFold does not claim any ownership, rights, or interest in your personal media.
  • Local Access Only: The App processes your media locally on your device solely to provide photo-culling, grouping, and organization capabilities.

3. Photo Culling & Deletion Responsibility

  • User Control: MomentFold provides organizational assistance to help you review and triage your photo library (such as marking items as Keep, Trash, or Archive).
  • Review Before Purge: Photos staged as “Trash” inside the App remain untouched in Apple Photos until you explicitly execute the Purge action.
  • System Authorization: Purging photos invokes Apple’s native iOS confirmation prompt. You are solely responsible for reviewing and confirming the deletion of any photos or videos. MomentFold is not liable for any photos deleted pursuant to your explicit system confirmation.
  • Recovery: Photos deleted through the official system dialog are generally retained in your device’s “Recently Deleted” album in Apple Photos for up to 30 days, subject to Apple’s standard Photos retention policies.

4. Privacy & Data Handling

Your privacy is paramount. MomentFold operates on a local-first architecture with no user accounts, no tracking, and no external media uploads. Our data practices are governed by our Privacy Policy, which is incorporated into these Terms by reference.

5. System Requirements

Use of MomentFold requires an Apple iPhone running iOS 26.0 or later and access to the Apple Photos library. The developer does not guarantee compatibility with operating system versions or devices that do not meet these minimum requirements.

6. Intellectual Property

The App, including its code, structure, design, graphics, user interface, icons, and branding (including the names “MomentFold” and “MomentFold（折影）”), is the property of Shanhe Yi and is protected by copyright, trademark, and other applicable intellectual property laws. You may not reverse engineer, decompile, disassemble, or extract the source code of the App, except to the extent permitted by applicable law.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOMENTFOLD IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

THE DEVELOPER DOES NOT WARRANT THAT THE OPERATION OF THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF DEFECTS, OR THAT DEFECTS WILL BE CORRECTED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PHOTOS, LOSS OF PROFITS, OR DEVICE DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Termination

These Terms are effective until terminated. Your rights under these Terms will terminate automatically without notice if you fail to comply with any provision. Upon termination, you must cease all use of the App and delete all copies from your devices.

10. Changes to Terms

We reserve the right to revise or update these Terms at any time. Any changes will be posted on this page with an updated “Effective Date.” Continued use of the App after any such changes constitutes your acceptance of the new Terms.
